(i) Employment Contract issues

Of all the aspects involved in running a business the law regulating the employment of staff is one of the most complicated and highly regulated. Below are a range of issues that you might have to deal with in the course of running your business.

  • Preparing a standard contract of employment for general use or a contract for a specific individual, perhaps with restrictions on what they can do if they leave.

  • Setting up a staff handbook containing your businesses policies and perhaps your disciplinary and grievance procedures.

  • Setting up a form of bonus or incentive scheme.

  • Changing contract terms perhaps for economic reasons or because of a change of location or style of working.

  • Transferring staff perhaps to an entirely different or to a subsidiary.

Whether you simply need some reassurance that your contracts or policies are compliant or whether you wish to set up new ones, we are able to assist.

(ii) Disputes with Employees

However careful and considerate you may be as an employer, there will be occasions when things go wrong. Sometimes those problems can be resolved direct with the member of staff. Sometimes they will not, and you may find a Tribunal claim arriving in the post. Common issues and disputes arise from issues relating to:-

  • Conduct or capability of employees

  • Discrimination (whether on the grounds of race, sex, age or disability)

  • Harassment/ bullying

  • Stress

  • Contract rights and obligations

  • Deductions from wages

  • Working Time Regulations

  • Minimum wage

  • Grievance/ disciplinary issues

  • Sickness/ long term illness

As a modest size legal practice our team that deals with employment issues have experience of both sides, that is representing businesses and employees at Tribunal. This gives them a keen insight into what needs to be done to successfully defend a Tribunal claim or settle the claim on the best terms.

If you believe that you might be on the receiving end of a claim or one has arrived on your doormat please feel free to contact us for a general discussion or full representation.

(iii) Terminating the Employee’s contract

If you are looking at terminating a contract of employment, whether it be for a reason associated with a specific employee such as his/her conduct or capability to do the job, or whether it is due to economic reasons i.e. redundancy, we can guide you through your statutory and contractual obligations and help make the entire process as painless as possible.

We can also draft the appropriate form of Compromise Agreement to resolve and settle any disputes that may have arisen between you and the employee.
