dispute resolution / litigation

Dispute resolution is a generic term mainly concerned with an area that used to be more commonly known as “litigation”. The use of the term has grown as the Courts in this country have encouraged the parties to “resolve” their differences rather than “fight” their cases through the Courts.

The range of issues covered by this term is extensive and some areas are dealt with in other sections of this site, but here are a few of the most common:-

  • Disputes between an architect or a builder and their client.
  • Disputes over land (rights of way, rights of light, rights of support, boundary disputes, neighbours from hell).
  • Accidents.
  • Disputes between partners or shareholders
  • Contractual disputes

The vast majority of disputes involve the following two principles:-

  • That a right, recognised by the law, has been infringed; and.
  • That someone has or expects to suffer some loss, usually financial.

The usual remedies sought are to stop the infringement and/or compensation.

In our experience there are few disputes that are clear cut. The cause of the problem needs to be analysed carefully, your legal position established, and the right approach and solution applied.

Sometimes mediation is the right approach. On other occasions a firm line might be appropriate. We will advise you of all options.

We will discuss the pros and cons and where appropriate, will give you guidance on the costs and benefits of one route over another.
